Failure to prosecute.

That is what the judge declared on the last scheduled trial date when the private complainant once again did not appear. She has been notified of the hearings but for some unexplained reason, did not appear.

When the state prosecutor went out of the courtroom though after the hearing, he found the private complainant sitting at a bench one floor down. The complainant was carrying a baby and explained that when she got there, the hearing has already started. She decided not to interrupt the trial and wait outside the courtroom.

The accused was freed because the complainant did not want to interrupt the proceedings.
