True Stories from the Courtroom: Deceased
There was a woman who wanted to have an affidavit subscribed by competent authority. She got to the office and presented her affidavit.
There's a problem.
She is not the affiant, the person who signed the affidavit. It was an affidavit supposedly executed by her husband, who had already died before. The affidavit states that the affiant last resided at a certain place. It was a requirement for the claim of death benefits by the heirs, she said.
The person who was to subscribe refused. The woman pleaded that it be subscribed and that they cannot exhume his corpse for him to sign. The answer was still a 'no.'
Finally, the woman had to give up after it was explained in this way,
"By subscribing that affidavit, it means the affiant, your husband, who is already dead, walked from his grave, came to this office, and told me that this is his signature."
